Quality Control Orders (QCOs) to Micro Enterprises

With the implementation of Extended Producer Responsibility (EPR) Rules, the Government is progressively strengthening the regulatory framework to ensure stricter compliance. The primary objective of these regulations is to hold businesses accountable for the environmentally sound collection, management, and recycling of waste generated by their products, including plastic packaging, electrical and electronic equipment, batteries, and tyres.

EPR compliance begins with the registration requirement, which is a critical and foundational step. Businesses must first conduct an initial assessment to determine whether they are mandatorily required to obtain EPR registration based on their activities and product categories. Upon such evaluation, the applicable type of EPR registration is identified. Broadly, there are five categories of EPR registration, as outlined below.

  1. EPR registration for plastic Packaging waste
  2. EPR registration for Electronics and Electrical prodcut
  3. EPR registration for Battery
  4. EPR registration for Tyers
  5. EPR registration for Used oils

How We Assist Businesses in Achieving EPR Compliance

At BR & Associates, we begin by thoroughly understanding the client’s business model, product portfolio, and operational activities. Based on this assessment, we advise whether the entity is mandatorily required to obtain EPR registration under the applicable regulatory framework.

It is important to note that certain exemptions are available under the relevant rules. For instance, micro and small brand owners are exempted from obtaining EPR registration under the Plastic Waste Management Rules, while under E-Waste regulations, exemptions are generally limited to micro enterprises. Accordingly, a careful evaluation is essential before proceeding with registration

Although EPR registrations are typically granted for a lifetime (unless suspended or cancelled by the Central Pollution Control Board), they entail ongoing compliance obligations. These include filing of annual returns for plastic, battery, and tyre EPR registrations, as well as both annual and quarterly returns in the case of E-Waste EPR.

In view of the above, obtaining EPR registration without proper evaluation may lead to unnecessary compliance burdens. Therefore, BR & Associates provides detailed advisory and end-to-end support to ensure that clients not only obtain the appropriate registration, where applicable, but also remain fully compliant with all regulatory requirements.
